Terms of use

These terms apply to anyone using Callio, whether through the console or by letting it answer a telephone line.
Who these terms are between
Callio is operated by 1892898 Ontario LTD (o/a CANDO IT Consulting LTD). In these terms, we and us mean 1892898 Ontario LTD (o/a CANDO IT Consulting LTD); you means the business using the service and anyone signing in on its behalf.
Using the service means you accept these terms. If you are agreeing on behalf of a business, you are confirming that you are allowed to.
Access is by invitation
There is no self-service way in. A business is set up by us, and accounts are created by invitation to a named email address. You are responsible for who you invite, for what they do once they are in, and for telling us when somebody should no longer have access.
Sign-in credentials are personal. Do not share them, and tell us promptly if you think an account has been reached by somebody who should not have it.
What the service does
Callio answers telephone calls made to a number you point at it. It answers questions using documents you provide, offers appointment times drawn from opening hours you set, transfers a caller to a number you nominate, takes messages, and writes a record of each call.
What the assistant says is produced from your documents by a speech model. It is built to refuse rather than guess, but it is software, and it can be wrong. Read your call records.
Not for emergencies
Callio must not be used for emergency, medical, safety or crisis lines, or for any number where a delayed or incorrect answer could cause harm. It cannot reach emergency services, it cannot judge urgency, and it will sometimes hand a caller to a voicemail.
Do not point a number at it that people would ring when something is seriously wrong.
Your documents and your settings
What you write stays yours. You give us permission to store it, index it and read it out to your callers, which is what the service is, and nothing more.
You are responsible for it being accurate. The assistant repeats your prices, your hours and your commitments to the people who telephone you, and a wrong figure in a document becomes a wrong figure said aloud to a customer.
How you may use it
You agree not to:
- Use it for anything unlawful, or to deceive, harass or defraud the people who call you.
- Present the assistant as a human being, or remove its ability to say what it is.
- Put it in front of calls that require a licensed professional, or that need a caller identified before anything can be discussed.
- Load documents you do not have the right to use.
- Try to reach another business's data, probe the service for weaknesses without our written agreement, or work around the limits it places on an account.
- Resell the service or give access to it to somebody else, unless we have agreed that in writing.
Availability
We work to keep the service running, and the design gives a caller a fallback at every point where something can fail. We do not promise it will be uninterrupted.
It depends on a telephone network and a speech model that we do not run. An outage at either will interrupt calls, and we will not always be able to say when it will end. Unless we have separately agreed a service level with you in writing, none is implied by these terms.
We may change, suspend or withdraw parts of the service. Where a change removes something you rely on, we will give you reasonable notice.
Fees
Any charge for the service, and what it covers, is what we have agreed with you in writing. Where nothing has been agreed, no charge applies and no service level does either.
Suspension and ending it
You can stop using the service at any time by pointing your number somewhere else and asking us to close your business account.
We may suspend or close an account that breaches these terms, that puts the service or another customer at risk, or where we are required to. Where the circumstances allow it, we will tell you first.
When a business account is closed, everything belonging to it is deleted. Export anything you want to keep before you ask us to close it.
No warranty
The service is provided as it is. To the extent the law allows, we make no warranties about it, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that what the assistant says will be accurate, complete or suitable for any particular caller.
Limits on liability
To the extent the law allows, we are not liable for lost profits, lost business, lost or corrupted data, or any indirect or consequential loss, however it arises.
Our total liability arising out of or in connection with the service is limited to the amount you paid us for it in the twelve months before the claim, or where you have paid us nothing, to one hundred units of the currency in which we would have invoiced you.
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
Your side of it
You will cover us against claims brought by a third party that arise from your use of the service in breach of these terms, from the content of your documents, or from your failure to tell your callers what the law where you operate requires you to tell them.
Changes to these terms
We may revise these terms. The date at the top changes when we do, and material changes will be notified to the email address on your account. Continuing to use the service after a change means the revised terms apply.
Governing law
These terms are governed by the law of Ontario, Canada, and the courts of Ontario, Canada have exclusive jurisdiction over any dispute arising from them.
